Terms of Service

By accessing or using GeminiLaunch ("Service"), creating an account, or publishing content through the platform, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

GeminiLaunch is a cloud publishing platform for turning AI-generated or hand-authored HTML and React code into publicly accessible websites. Features include project hosting on GeminiLaunch subdomains, optional custom domains on paid plans (subject to plan limits), metadata and asset fields you configure, and tools to update and republish your sites.

We may change, add, or remove features over time. We will try to give reasonable notice for changes that materially affect paid customers, but we do not guarantee uninterrupted availability of any specific feature.

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be legally able to enter a binding contract in your jurisdiction to use paid features; for the free tier, you must comply with these Terms and applicable law.

You retain ownership of intellectual property rights in the code, copy, media, and other materials you upload or publish ("Your Content"). To operate the Service, you grant GeminiLaunch a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute Your Content solely to provide, secure, and improve the Service (including serving your site to visitors and supporting domains you connect).

You represent that you have the rights necessary to grant the above license and that Your Content does not violate these Terms or the rights of any third party.

You agree not to use the Service to:

• Violate any law or regulation
• Distribute malware, phishing, spam, or deceptive or harmful code or links
• Infringe intellectual property, privacy, or publicity rights of others
• Attempt to gain unauthorized access to the Service, other accounts, or underlying systems
• Mine cryptocurrency, run high-abuse batch jobs, or overload our infrastructure in ways unrelated to normal publishing use
• Resell or sublicense the Service without our written permission

We may remove or disable content, suspend accounts, or take other action if we reasonably believe you have violated these rules or pose a risk to the platform or other users.

Connecting a custom domain requires you to control DNS at your registrar or DNS host and to follow our verification steps. You are responsible for correct DNS configuration, renewals with your registrar, and compliance with policies of any third-party infrastructure used to route traffic. We do not guarantee instant propagation or uninterrupted DNS resolution outside our control.

We currently offer a Free tier (Free) with core publishing and GeminiLaunch subdomains, and paid plans including Pro ($15/mo) and Scale ($39/mo) with the entitlements described on our pricing page. Plan names, limits, and prices may change; we will post updates on the site and, where required, notify you before changes affect your next billing cycle.

Paid subscriptions are billed through our payment processor (Stripe). By subscribing, you authorize recurring charges until you cancel. You are responsible for applicable taxes. Except where required by law, fees are generally non-refundable once a billing period has started; if you believe a charge is in error, contact us promptly.

You may cancel a paid subscription through the billing flow in the product or as instructed in your account. Cancellation stops future renewals; access to paid features may continue until the end of the current period unless stated otherwise.

The Service—including software, branding, templates we provide (when available), and documentation—is owned by GeminiLaunch or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you in these Terms, no rights are transferred to you.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT YOUR CONTENT WILL BE FREE FROM LOSS OR CORRUPTION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEMINILAUNCH AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

You will defend and indemnify GeminiLaunch and its affiliates, officers, and agents against any third-party claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if we are required to do so by law, or if we discontinue the Service (with reasonable notice where practicable). Provisions that by their nature should survive (including ownership, disclaimers, limitations, indemnity, and governing law) will survive termination.

These Terms are governed by the laws of the State of Delaware, United States, excluding its conflict-of-law rules. You and GeminiLaunch consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service, subject to any mandatory consumer protections in your country of residence.

We may modify these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes to paid subscriptions, we will provide notice as required by law or reasonable commercial practice. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
